Business use and agreement
Starforge services are offered for business and commercial use. In these Terms, Starforge means the operator of starforgegta.ca, reachable at starforgegta@gmail.com. The customer confirms that they have authority to act for the named business. A standard purchase page or private offer, these Terms, the Privacy Policy and Billing & Cancellation page form the agreement. The accepted offer controls if its specific scope or commercial terms differ from these general Terms.
Service scope and customer-controlled systems
Starforge provides only the system and support described in the accepted plan, private offer or later written change. Work outside that scope requires separate written agreement. The customer must have authority to connect and instruct Starforge to use the supplied accounts, data, communication channels, domains, calendars, software and other systems. The customer remains responsible for business decisions, source data, approvals, staff use and the accuracy of information supplied to Starforge.
Included messaging usage
When a plan says SMS usage is included, Starforge covers standard provider and carrier delivery charges only for reasonable usage within the agreed workflow, sender, audience, geography and message pattern confirmed during onboarding. Included usage is not unlimited and does not include bulk or unsolicited campaigns, extra phone numbers, unusually high volume, excessive retries, long-message segments, international or premium traffic, additional campaigns, resale, attempts to evade carrier or platform controls, or messaging outside the agreed workflow. Starforge may limit or pause unlawful, abusive, unsafe or materially higher-than-agreed usage. If actual needs materially exceed the agreed workflow, Starforge will notify the customer and obtain a separate written scope before adding a charge.
Electronic messages and consent
The customer must provide lawful contact data and document every consent or other legal basis required for email, SMS and other commercial electronic messages. Campaigns must use accurate sender identification, a readily usable unsubscribe method, current suppression records and any other disclosures required by law. The customer must honour unsubscribe requests within the legally required period, including CASL’s maximum of 10 business days where it applies, and retain evidence supporting the consent or other basis relied upon. Starforge configures systems from the customer’s approved instructions and records; accepting these Terms does not create consent from any message recipient or transfer the customer’s legal obligations to Starforge.
Calls, Voice AI and recordings
The customer must not activate telemarketing, automated dialing, synthesized or prerecorded voice, call recording or transcription without the express consent where required, notices, registrations, calling-hour controls, National and internal do-not-call procedures, and records required for the intended recipients and jurisdictions. Voice AI must identify or describe itself where required and include an approved human escalation path. Starforge may require written compliance confirmation before activation and may suspend a flow that creates a legal or platform risk.
Reviews and platform decisions
Essential includes one questionable Google review case per month covering assessment, a policy-based report, and the available appeal when appropriate; additional cases require separate scope. Google and other platforms make the final decision. Removal, timing, rating, ranking and review volume are not guaranteed, and reviews that comply with the platform’s policies may remain. Starforge does not create, buy, incentivize, suppress or selectively solicit reviews. The customer must provide accurate supporting information and must not request fabricated, misleading, undisclosed or manipulated reviews or endorsements.
AI-assisted output and human review
AI-generated or AI-assisted text, classifications, summaries, replies, calls and recommendations can be incomplete, inaccurate or unsuitable. Unless a written scope expressly authorizes a tested low-risk automatic action, the customer must review and approve customer-facing content and material business decisions. Starforge output is not legal, medical, financial, employment or other regulated professional advice and must not be used for deception, impersonation, unlawful discrimination or unsupported performance claims.
Personal information and security
Each party must handle personal information lawfully and use reasonable safeguards. The customer must limit supplied data to what is necessary, provide required notices and consents, honour access, correction, deletion, retention and suppression obligations, and notify Starforge promptly of relevant incidents or unauthorized access. Starforge may use approved service providers to operate the service as described in the Privacy Policy. No internet-connected system can be promised to be completely secure.
Starter website scope
Essential includes one template-based starter website page and one consolidated revision round. Growth may include an expanded template-based starter website of up to four pages and two consolidated revision rounds. The customer supplies or approves business copy, images and other assets and confirms the right to use them. Domain registration, ecommerce, custom applications, extra pages, extra revisions, accessibility remediation beyond the agreed template and other custom work are separate unless the written scope says otherwise.
Trials, billing and cancellation
Stripe collects a payment method when a trial starts. Standard Essential and Growth recurring service is free for 14 days and automatically begins billing afterward unless cancelled first. Prices, billing frequency, first and later charges, any setup fee and the cancellation path are shown before acceptance and further described on the Billing & Cancellation page. A browser redirect is not payment proof; signed Stripe events determine trial and billing status. No general refund promise exists unless written in an accepted offer, and nothing limits a right that applicable law does not permit the parties to limit.
Third-party services and availability
Automation depends on customer-controlled and third-party services such as Google, telecommunications carriers, AI providers, calendars, CRMs, hosting and payment platforms. Their outages, policy changes, account restrictions, deliverability decisions, model behaviour and removal decisions are outside Starforge’s control. Starforge will use reasonable care in providing the agreed service but does not promise uninterrupted or error-free operation, permanent compatibility or a particular third-party decision.
No business-outcome warranty
Starforge does not guarantee any number of reviews, rating, ranking, lead, booking, sale, revenue amount, cost saving, response rate, removal result or other business outcome. Results depend on the customer’s offer, operations, market, data, consent records, responsiveness, third-party platforms and other factors outside Starforge’s control.
Limitation of liability
To the maximum extent permitted by law, Starforge is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profit, revenue, opportunity, goodwill, anticipated savings, data or business interruption, arising from the service or a third-party system. To the maximum extent permitted by law, Starforge’s total aggregate liability arising from the affected service will not exceed the fees actually paid to Starforge for that service during the three months immediately before the event giving rise to the claim. This section does not exclude liability for Starforge’s fraud, wilful misconduct or gross negligence, breach of confidentiality or privacy obligations, or any liability or statutory right that cannot lawfully be excluded or limited.
Customer responsibility and indemnity
To the maximum extent permitted by law, the customer will defend, indemnify and hold Starforge harmless from third-party claims, penalties, costs and reasonable legal fees arising from the customer’s unlawful messages or calls, deficient consent or suppression records, unauthorized or inaccurate data, infringing materials, deceptive claims, misuse of AI output, violation of platform rules, or instructions outside the agreed lawful scope. This obligation does not apply to the extent a claim was caused by Starforge’s fraud, wilful misconduct, gross negligence or breach of its confidentiality or privacy obligations.
Suspension and termination
Starforge may pause or limit a system when continued operation creates a security, legal, payment, abuse or platform-compliance risk. The customer remains responsible for charges properly incurred before termination. Cancellation of recurring billing is governed by the Billing & Cancellation page and the accepted offer. Provisions that by their nature should survive termination, including payment, confidentiality, liability and indemnity terms, continue to apply.
Governing law and non-waivable rights
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, and disputes may be brought in the courts of Ontario, subject to any forum or procedural right that applicable law does not allow the parties to waive. Nothing in these Terms waives a substantive or procedural consumer right, privacy right, statutory remedy, cancellation right or other protection that cannot legally be waived. The parties may agree to mediation or another resolution process after a dispute arises.
Entire agreement, changes and severability
The accepted plan or offer, these Terms, the Privacy Policy, the Billing & Cancellation page and any signed written change form the agreement for the service. Material scope or price changes require written agreement. Starforge may publish revised general Terms for future purchases; the version accepted with an offer remains the version for that acceptance unless the parties lawfully agree otherwise. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue.
